General Terms and Conditions

Below we would like to present our General Terms and Conditions, which we apply for the processing and handling of your purchase.

1. Conclusion of Contract
The customer's order constitutes an offer. A contract is only concluded after acceptance by us. Customers will be notified of our acceptance by email. An order is only possible if all mandatory fields are completed. If information is missing or we cannot fulfill the order for other reasons, customers will receive an error message. Before finally submitting the order, customers have the opportunity to correct their order. Supporting detailed information is provided to customers directly during the ordering process. Once the order is completed, customers are notified via an information window. This does not yet constitute our acceptance of the customer's offer.
1.1. Acknowledgment of Receipt
As soon as the order has been received by us, customers will be notified of the receipt of their order via the email address they provided. This notification does not yet constitute our acceptance of the offer.
1.2. Contract Language
Contracts are concluded exclusively in German.

2. Prices
All prices are total prices. They include all taxes, including VAT and duties, as well as shipping costs.

3. Payment
In principle, we offer the payment methods advance payment, credit card, and eps online transfer. We reserve the right not to offer certain payment methods for each order and to refer to other payment methods. Please note that we only accept payments from accounts within the European Union (EU). Any costs of a money transaction are to be borne by you.
You agree to receive invoices and credit notes exclusively in electronic form.

Any refunds will be made automatically to the account you used for payment. If you paid via PayPal or credit card, the refund will be made to the associated PayPal or credit card account.

4. Right of Withdrawal
Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods or, in the case of partial deliveries, the last delivery.

To exercise your right of withdrawal, you must inform us - SMARTBLU.at, Galling 1, A-9063 Maria Saal or shop@smartblu.at - of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form for this purpose. However, this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the communication exercising the right of withdrawal before the withdrawal period expires.

If you withdraw from this contract, we will refund all payments received from you, except for delivery costs, without delay and at the latest within fourteen days from the day we receive the notification of your withdrawal from this contract. We will use the same payment method you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for this refund. We may withhold the refund until we have received the goods back or you have provided proof that you have sent the goods back, whichever is earlier. You must return the goods without delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. You bear the direct costs of returning the goods.

B2B customers (companies) are excluded from returns and withdrawal rights.

5. Warranty
The provisions on statutory warranty apply. The warranty period for the delivery of movable goods is two years from the date of acceptance of the goods.
Complaints based on statutory warranty claims or other complaints can be made using the contact details provided in the imprint.

6. Shipping and Delivery
We ship our packages with the delivery service of the Austrian Post. This guarantees our customers fast delivery. The exact delivery time depends on various factors, so there is no guaranteed delivery period. All shipments are packed in a suitable box and sent insured. Shipping costs are calculated dynamically based on item weight and value and are displayed during the payment process.

Packages that could not be delivered to the customer due to missing or incorrect address information provided during the order and are returned will be charged a handling fee of 14.90 euros. A re-shipment will be charged separately at 4.90 euros. This also applies to packages that are not picked up from pickup points within the deadline and are therefore returned.

7. Retention of Title
The goods remain our property until full payment of the purchase price.
